KYC/AML Policy

ASORTIO's KYC and AML Policy is designed to prevent money laundering, terrorist financing, fraud, and other financial crimes. By accepting our Terms of Service, you agree to comply with this Policy.

1. Purpose

This Policy aims to ensure compliance with the EU Anti-Money Laundering Directive (AMLD) and other applicable regulations, fostering transparency and trust within the financial system. ASORTIO takes its obligations seriously and implements robust measures to identify and verify the identities of its clients.

2. Identification and Verification

To comply with our KYC obligations, we may require you to provide the following information:

  • Personal Information:

    • First Name

    • Last Name

    • Residential Address

    • Telephone Number

    • Email Address

    • Date of Birth

    • Taxpayer Identification Number

    • Government Identification Number

  • Bank Account Information:

    • Name of the Bank

    • Account Type

    • Routing Number

    • Account Number

2.1. Document Requirements

In addition to the above information, you may be required to submit various documents to verify your identity, including:

  • A government-issued photo ID (e.g., driver’s license, national ID card, or international passport).

  • Proof of address, such as a bank statement, utility bill, or tax document dated within the last three months.

  • Video identification may be requested during the onboarding process.

Note: All documents submitted should be valid and current, listing your name and residential address.

2.2. Verification Process

Our verification policy is structured as follows:

For Transactions Below €10,000:

  • Create an account and verify your email and phone number.

  • Provide a government-issued photo ID (national ID or passport) for verification.

  • Complete a video identification process to confirm your identity.

For Transactions of €10,000 or More:

  • Create an account and verify your email and phone number.

  • Provide a government-issued photo ID (national ID or passport) for verification.

  • Provide proof of address (e.g., bank statement, utility bill, tax document).

  • Provide proof of source of funds (e.g., bank statement, tax document, sale agreement).

  • Complete a video identification process to confirm your identity.

2.3. Ongoing Verification

We reserve the right to perform ongoing verification of your identity, especially if:

  • Your identification information changes.

  • Your activity appears suspicious or unusual.

You agree to keep us updated with any changes to your personal information or documents.

3. Third-Party Verification

We may conduct inquiries through third-party services to verify your identity and mitigate the risk of fraud or financial crime. By agreeing to this Policy, you consent to the disclosure of your personal information to credit reference and fraud prevention agencies, who may respond to our inquiries.

4. Transactions Monitoring

ASORTIO employs monitoring systems to analyze your transactions to detect suspicious activities. Our monitoring activities include, but are not limited to:

  • Data capture

  • Filtering and record-keeping

  • Investigation management

  • Reporting to the appropriate authorities when necessary

5. Actions on Suspicious Activities

We reserve the right to take the following actions if we suspect involvement in illegal activities:

  • Report suspicious transactions to law enforcement agencies.

  • Request additional information and documentation to clarify suspicious transactions.

  • Suspend or terminate your account pending investigation of illegal or suspicious activities.

6. Risk Assessment

ASORTIO employs a risk-based approach to customer due diligence, assessing the risk associated with clients based on various factors, including but not limited to:

  • The nature and purpose of the business relationship.

  • The customer’s country of origin and geographic risk.

  • The client’s transaction patterns.

7. Compliance and Training

We commit to providing ongoing training to our employees regarding KYC/AML regulations and the importance of identifying and reporting suspicious activities. This training will ensure that our team remains vigilant and informed of the latest developments in AML compliance.

8. Record-Keeping

ASORTIO will maintain records of all identification documents and transaction histories in compliance with applicable EU regulations for a minimum of five years following the termination of our relationship with you or the completion of the relevant transactions.

9. Changes to the KYC/AML Policy

We reserve the right to amend this KYC/AML Policy at any time. Users will be notified of significant changes, and continued use of our services after such changes indicates your acceptance of the new terms.
